How does filing for bankruptcy protection impact income tax debt?

When you file for bankruptcy, the IRS is subject to the same rules and restrictions as any other creditor. The automatic stay that immediately goes into effect upon the filing of your bankruptcy case means the IRS must stop all debt collection actions, including wage garnishments, while your bankruptcy case is pending. Determining if you can eliminate tax debt under Chapter 7 or Chapter 13, depends on specific set of criteria which include:

  • Incurring the tax debt within a relatively recent period of time. The most recent tax due date is over three years old, adding additional time for the time any bankruptcy-related automatic stay was in effect and then an additional 90 days.
  • Taxes were assessed by the IRS more than 240 days before filing bankruptcy, plus any extension due to an offer in compromise or because an automatic stay was in effect, plus 30 days or 90 days, depending on the type of debt owed.
  • Taxpayer filed their 1040 tax return more than 2 years earlier, or an equivalent notice or report.
  • Any tax returns in question were not fraudulent in any way.
  • Taxpayer made no attempt at tax evasion.
